Practising Without A Valid Practising Certificate

Dear Members of the Kuala Lumpur Bar,

It has come to our attention that Members of the Bar have encountered individuals who have appeared before Judges in the Kuala Lumpur Courts despite not being in possession of a valid Practising Certificate.

Whilst we are looking into the matter and liaising with the Judiciary and the Police, Members and Pupils are requested to collate and forward any relevant information to Noratikah (noratikah@klbar.org.my) accordingly.

All correspondence will be kept strictly confidential.

In the meantime, Members are reminded of Section 29(3) of the Legal Profession Act 1976 (“LPA”) which provides that if a Member has duly complied with section 29(1) of the LPA (relating to the application for Practising Certificates) “in the month of January of any year, the Practising Certificate issued to him in respect of that year shall be deemed to have been in operation from the 1st day of January of that year”.

 
In respect of Members who are not in possession of a valid Practising Certificate on or before 31 Jan 2022, the Bar Council may institute disciplinary proceedings against such Members after 31 Jan 2022, except where such Members have lodged with the Bar Council a Notice of Cessation of Practice together with all the relevant statutory documents.
