Meeting With LHDNM On 20 December 2023

Dear Members of the Kuala Lumpur Bar,

The Kuala Lumpur Bar Committee Corporate & Conveyancing Practice Committee (“KLBC CCPC”) has received feedback from Members on issues faced when dealings with the Inland Revenue Board of Malaysia (“LHDNM“).

KLBC CCPC wrote to LHDNM on 21 September 2023 requesting for a meeting to discuss and resolve these issues. Subsequent thereto, a meeting was held on 20 December 2023 between KLBC CCPC and LHDNM.

We set out below the outcome of the issues discussed during the said meeting:-

Delays In The Adjudication Process

LHDNM informed that they have looked into this issue and will be implementing changes commencing from January 2024. If there are further issues and/or complaints arising thereafter, please inform the KLBC CCPC so that we may escalate such issues to LHDNM.

LHDNM clarified that LHDNM practices an open door policy for submission of instruments for adjudication of stamp duty. Members may select and submit instruments for adjudication of stamp duty at any LHDNM branch. Of course, for instruments relating to real estate and requiring the involvement of Jabatan Penilaian Dan Perkhidmatan Harta, members are advised not to submit to a distant LHDNM branch.

Members are also advised to ensure the accuracy of information submitted to avoid delays.

Members may check the status of their matters with the officer in charge at the relevant branches. Please find enclosed a list of officers in charge for each state.

Technical Issues With The Portal

The issue of data loss despite saving the inserted information has been highlighted to LHDNM. LHDNM will be referring the issue to their technical team.

LHDNM has also shared that if any other assistance pertaining to the Stamp Assessment And Payment System (“STAMPS“) is required or if there are any other technical issues to be raised, members may contact LHDNM directly via email at stamps@hasil.gov.my.

Information For Income Tax Number And Branch

Members may contact LHDNM directly via e-mail to obtain information on income tax number and branch at eckht@hasil.gov.my.

Program Khas Pengakuan Sukarela 2.0 (“PKPS”)

LHDNM pointed out that the PKPS is ongoing until May 2024 and members may wish to share this with their clients. Further information pertaining to this programme can be found here.
