COVID-19 | Law Firms Urged Not To Unilaterally Impose Or Force Employees To Take Annual Leave Or Unpaid Leave

Dear Members of the Kuala Lumpur Bar,

It has come to the attention of the Kuala Lumpur Bar Committee that certain law firms are forcing their employees to take Annual Leave or Unpaid Leave during the Movement Control Order (MCO) period.

We would like to remind member firms that as employers, they are to be mindful of Malaysian labour and employment laws and to adhere to the contractual terms of employment with their respective employees.

We urge member firms to seek advice prior to unilaterally imposing or forcing their employees to take Unpaid Leave or Annual Leave during the MCO period.

We also urge member firms to be mindful of the Human Resource Ministry’s MCO directives.

In these trying times, we urge both employers and employees to work together transparently to find the best solution.

Thank you.

Regards,
Harleen Kaur (Leena)
