Dear Members of the Kuala Lumpur Bar,
The Malaysian Bar’s Criminal Law Committee (“CLC”) will be meeting with the Chief Judge of Malaya, Yang Amat Arif Datuk Seri Hashim bin Hamzah, to discuss issues concerning the preparation of Notes of Evidence in criminal cases.
In preparation for this engagement, the Criminal Law Practice Committee (“CLPC”) is currently compiling feedback on this issue to be escalated to the CLC for further consideration and action.
Criminal practitioners are invited to provide feedback on any issues encountered in relation to the preparation of Notes of Evidence for criminal matters, including but not limited to:
- Delays in the preparation or provision of Notes of Evidence;
- Difficulties in obtaining certified copies;
- Issues relating to the accuracy or completeness of Notes of Evidence or transcripts;
- The impact of such issues on appeals, case management, or the conduct of proceedings; and
- Suggestions for improving the current process.
