Circular No: 127/2023

We refer to the Malaysian Bar’s Circular No 233/2019 dated 25 October 2019 with respect to the suit filed by LexisNexis Malaysia Sdn Bhd (“LexisNexis”) against the Malaysian Bar.
Ultimately, an amicable settlement (‘the Settlement’) was reached by both parties and a Subscription Agreement was entered into on 17 November 2022 between Lexis Nexis and the Malaysian Bar.
The terms of the said Agreement are, among others, as follows:
- LexisNexis will provide all Members and pupils in chambers (“pupils”), the Malaysian Bar library, and all State Bar libraries access to Lexis Advance Malaysia, which includes Malayan Law Journal Reported Cases, Malayan Law Journal Unreported Cases, Malayan Law Journal Articles, Unannotated Statutes of Malaysia, Shariah Law Report, and Industrial Law Journal (“Services”) — with a carve-out for Members who are solely members of the Selangor Bar;
- The said access to Lexis Advance Malaysia will begin on 19 Dec 2022 and end on 18 Dec 2023 (“duration of services”); and
- In consideration of the above, the Malaysian Bar will make payment of RM1,330,000 in seven tranches to LexisNexis
With effect from 19 December 2022, Members and Pupils were able to access Lexis Advance Malaysia from the Malaysian Bar Webpage.
As the Subscription Agreement will expire on 18 December 2023, the Bar Council is considering entering into negotiations for renewal of the existing agreement. To that end, the Bar Council had established an Ad Hoc Committee for Lexis Nexis Negotiation with the objective to negotiate with LexisNexis for an offering which will be most beneficial to members of the Bar.
In order to have a better understanding of the interest of Members of the Malaysian Bar, the Bar Council Adhoc Committee for LexisNexis Negotiation would like to seek your cooperation to fill up the survey form by Thursday, 21 September 2023.
